Legal form: the co-ownership is managed in the form of a public limited company. Each owner holds a number of registered shares. The advantage of this form lies in the transmission between seller buyer, which is free of charge. The transmission is recorded in the legal book kept by the trustee in charge of the company. Another difference compared to the more common joint-stock company in Switzerland, the SA registers all the expenses related to the real estate property. Each owner is practically exempt from Swiss tax charges on a personal basis. This exempts him, if he is a foreigner, from all tax declarations unlike the owner in a property divided by floor, hence, if necessary, a huge advantage in terms of discretion. (The obligation for foreigners to prepare a tax return in Switzerland annually often leads them to call on a fiduciary).

Buying via a real estate company has its advantages... If some households choose to acquire their property via an IS, it is necessarily because they find their account there , both during the acquisition, during the detention and at the time of transfer .
As of the purchase, which consists, let us remember, of the acquisition of shares, three advantages are identifiable:
  • The absence of transfer rights.
  • The absence of registration in the Land Registry.
  • The absence of notary fees.
If these various sums are not payable, it is quite simply because there is no effective transfer of ownership since the real estate company remains the sole owner of the building. During the detention of the property, various tax advantages are also available:

  • Economic double taxation . By purchasing the shares of a real estate company, an individual will have to pay a double dividend tax . Indeed, in Switzerland, a first taxation hits the profits of capital companies then when the dividends are added to the income of the shareholders, a second taxation takes place.
